The Food and Drug Administration (FDA) has a deadline of September 9th, 2020 for all eLiquid manufacturers to submit the awfully expensive and draconian Pre-Market Tobacco Application (PMTA for all of their juice lines, per SKU code. Quite simply, many of the small companies will not be able to afford this government requirement.
Big tobacco companies have had no problem with their applications, they have very deep pockets and are very well connected. This is not the case for the vaping community companies. Most are small to medium size and have been heavily taxed and restricted over the past 5+ years so resources are limited despite what we may think due to their size.
They have not become rich, despite the POTUS and politicians’ claims to the contrary. What the deadline will mean for many of the companies is the death of their company they have worked hard to build in an effort to provide our community with quality, enjoyable vaping liquids to help keep us off cigarettes.
What this will mean for our friends and neighbors is the selections we have today may not be what we are able to have after the deadline. Some of the companies will likely be able to go through the process. Those that do will have 1 year from the deadline to stay on the market while the FDA reviews and approves or denies applications.
Those that cannot meet the excessive PMTA requirements will be forced off the market and out-of-business so their eJuices will be deemed by our government to be illegal for any retailer or distributor to sell. Yes, the government is once again picking winners and losers but that is another discussion for another time.
Right now we want our community to know we are actively reaching out to discover who has submitted, or will submit the PMTA for their products and which products the company included in the application process. From there we can start to look at what we will have to choose from and begin the process of bringing in what our government will deem legal while under review.
As we bring in new brands and eliminate brands that we may love but that will be illegal (per government edict) please understand this is not a Wood Creek Vapory decision. It is a reality of what the government is doing to help crush the mom and pop side of vaping while promoting the big tobacco companies and big pharma companies with their vaping and nicotine reduction products deemed legal.
